RESOLUTION NO. 1990-140

SUBJECT: LANDS AND RESOURCES

WHEREAS there exist aboriginal and treaty rights of First Nations in Canada;

WHEREAS resource development in aboriginal territories in most cases has disregarded the rights of aboriginal peoples, has been detrimental to the environment and has been carried out for the benefit of outside interests;

WHEREAS the timber, mineral, hydroelectric and other resource potential of Northeastern Ontario is increasingly proposed for development by private interests and the Province;

WHEREAS land and resource development in Mushkegowuk Council territory without approval

of the Mushkegowuk First Nations is contrary to law and the inherent rights of Mushkegowuk First Nations;

BE IT THEREFORE RESOLVED that until a structure for addressing lands and resources issues is in place that recognizes Mushkegowuk rights and jurisdiction over lands and resources, no resource development in Mushkegowuk traditional lands is endorsed or recognized by Mushkegowuk First Nations;

BE IT FURTHER RESOLVED THAT this Assembly instructs the Board of Chiefs through its administration to develop and plan both short term and long term options for the Mushkegowuk Council to consider that address issues related to the development of resources in its traditional lands including options such as

a Lands Council, a Partners in Change Model, management Regimes, a natural resources

secretariat, and a Lands and Resources Development Protocol;

BE IT FURTHER RESOLVED THAT the Board of Chiefs is mandated to commence preliminary discussions on options with the appropriate authorities and that this Assembly reserves the right to ratify any and all such agreements in these proceedings.
