RESOLUTION NO. 1996-08-14

SUBJECT: ROYALTIES AND RESTORATION FOR AGGREGATES USED IN FIRST NATION CONSTRUCTION

WHEREAS federal or provincial governments have in the past demanded royalties or permit approvals (or waivers) when aggregates are used from off-reserve First Nation traditional lands (so-called Crown lands) for purposes of First Nation construction projects;

WHEREAS the federal or provincial governments do not recognize the value of such aggregates when on­reserve First Nation aggregates are used for First Nation construction projects, and do not provide royalties or compensation to the First Nation for the aggregates, and do not provide funding for restoration of reserve lands;

THEREFORE BE IT RESOLVED that federal or provincial governments recognize the fair value of on-reserve aggregates when they are used in First Nation construction projects;

BE IT FURTHER RESOLVED the federal and provincial governments allocate and provide funding for payment to First Nations for compensation for use of on-reserve aggregates, and for restoration of aggregate sites, when
