ENFORCEMENT OF LIQUOR TRAFFICKING RESTRICTIONS

WHEREAS alcohol abuse continues to be a problem in some Mushkegowuk communities, and is made worse by the illegal sale of alcohol (bootlegging);

WHEREAS Chiefs and Councils and First Nation police forces who attempt to enforce liquor laws are often frustrated by the inability of First Nation law enforcement officers to obtain search warrants to enter houses, and the inability of such officers to enter houses owned by a First Nation;

THEREFORE BE IT RESOLVED that the Mushkegowuk Assembly authorizes the investigation of whether it is legally practical for Mushkegowuk Chiefs and Councils to pass by-laws facilitating police searches, and to use First Nation membership laws to create sanctions against "bootleggers".
