RESOLUTION NO. 1992-15

Subject: Activities on Traditional Lands

FURTHER to the Statement of Political Relationship between the province of Ontario and the First Nations;

AND FURTHER to the letter from Bud Wildman, Minister of Native Affairs dated August 24, 1992, in which he states that "the provincial government ... is committed to proceeding with self-government negotiations in the Mushkegowuk region";

AND WHEREAS there are present cases, throughout the Mushkegowuk region, where outside business interests are pursuing mineral or other activities on traditional lands without the consent of Mushkegowuk First Nations;

AND WHEREAS the present NAN Interim Measures Agreement does not provide Mushkegowuk First Nations with adequate control over activities in traditional Mushkegowuk territory, resulting in arbitrary decisions by the Ministry of Natural Resources regarding whether or not specific activities or permits fall under the Interim Measures Agreement;

AND WHEREAS the present NAN Interim Measures Agreement does not provide adequate resources to Mushkegowuk First Nations to deal with those matters presently covered by the Interim Measures Agreement;

THEREFORE BE IT RESOLVED THAT Mushkegowuk Council will enter into discussions with Ontario with intent to enter into a Traditional Territory Agreement with the Province of Ontario which would ensure, at a minimum, that all activities of outside parties in the Mushkegowuk Traditional Territory be subject to prior consent of the affected First Nation;

AND BE IT FURTHER RESOLVED THAT the Traditional Territory Agreement would include access to adequate financial resources to ensure that all outsider proposed activities can be addressed in a timely and complete manner.
