RESOLUTION NO. 1993-09

Subject: LCBO in Moosonee

WHEREAS all of the Mushkegowuk communities are directly affected by alcohol consumption and in particular the presence of the Liquor Control Board of Ontario (LCBO) outlet in Moosonee;

AND WHEREAS Mushkegowuk Council and its member First Nations have self-government rights as recognized by the statement of Political Relationship;

AND WHEREAS Mushkegowuk Council has initiated discussions with LCBO with regards to operations of the store in Moosonee;

THEREFORE BE IT RESOLVED that:

LCBO will provide the following information to Mushkegowuk Council by October 31, 1993:

a formal legal opinion from Ontario regarding who, and under what circumstances, has the authority to close the LCBO store in Moosonee whether for temporary or permanent closure

a formal legal opinion from Ontario regarding LCBO's ability to implement policies designed to restrict bulk purchases

iii) a complete report, with

regarding the opening of the Moosonee LCBO outlet including who requested or initiated the opening and how the decision to open the store was reached

iv) a summary financial report indicating the monthly total sales and profits of the Moosonee LCBO outlet over the last ten years

2. The Government of Ontario must recognize the social impacts of alcohol on our own people and must provide adequate resources to enable the communities to deal with these issues

3. The Government of Ontario will direct the profits realized by the LCBO towards social service agencies within the Mushkegowuk region

4. The Government of Ontario will provide resources to enable Mushkegowuk Council to investigate the following issues:

-options with regards to establishing a Mushkegowuk controlled Liquor Control Board to operate within the region

-the legal liability of the province and the LCBO with regards to incidents resulting from bulk sales and sales to minors.

AND BE IT FURTHER RESOLVED that Mushkegowuk Council and the Mushkegowuk communities including Moosonee will continue discussions with Ontario with regards to the operations of the LCBO store in Moosonee to the mutual satisfaction of all parties.
