RESOLUTION NO. 1998-08-15

SUBJECT: ELIMINATION OF SECTION 6(2) OF THE INDIAN ACT

WHEREAS the present section 6(2) of the Indian Act, adopted as part ofBi11 C-31, arbitrarily and unjustly "cuts off' the ability of certain descendants of certain native women to be recognized as Aboriginal persons;

WHEREAS Aboriginal persons and communities have the right to define who we are, and Aboriginal women have the right not to be discriminated against;

WHEREAS the Ontario Native Women's Association is carrying out a continuing effort to have section 6(2) of the Indian Act eliminated, and has determined to bring this matter to the United Nations;

THEREFORE BE IT RESOLVED that the Chiefs in Assembly support the elimination of section 6(2) of the Indian Act, because of its arbitrary and unjust cut-off of the rights of persons and communities to define who we are;

AND BE IT FURTHER RESOLVED that the Chiefs in Assembly support the Ontario Native Women's Association in its efforts to have section 6(2) eliminated and to bring this matter before the United Nations.
